This contract for the personal services of musician(s) on the Engagement below is made on the day of _______/________/________, between the undersigned: herein called “Purchaser” and the performer(s), herein called “Artist”.
The Artist agrees to render to the Purchaser personal services and the Purchaser agrees to hire the Artist on the following terms and conditions: 1. 6. Recording of Engagement: No performance shall be recorded, reproduced or transmitted in any manner without permission from Artist or Artist’s Management. 7. It is hereby agreed that the undersigned Artist is an independent contractor and not an employee of the undersigned Purchaser.
8. The agreement of the Artist to perform is subject to proven detention by sickness, accidents, riots, strikes, epidemics, acts of Nature (hurricane, flood, tornado, etc), or any other legitimate condition beyond control; if such occurs, Artist’s deposit shall be returned in full to Purchaser.
9. Purchaser understands that he/she is obligated to pay in full for services contracted of Artist unless it becomes impossible for the Purchaser to provide a place of performance due to acts of Nature (hurricane, flood, tornado, etc); in such case, the deposit shall be retained by the Artist and Purchaser is not under obligation to pay remainder; otherwise, regardless of circumstances of Engagement on behalf of the Purchaser, remainder of full amount agreed upon in this contract is due to the Artist on or by the date of Engagement.
10. This contract shall be governed by the State of Arizona
